The three murder suspects of former police spokesperson Andrew Felix Kaweesi have on Thursday 26 asked court to dismiss forgery charges against them for lack of powers to try them.
The three including Noordin Higenyi also known as Taata Abdallazak, Abdurashid Mbaziira, and Bruhan Balyejusa appeared before a grade one magistrate at Nabweru Court, Mr George Mfitundinda for the hearing of the case in which they are accused of procuring National IDs in other people’s names.
However, through their lawyer, Wameli objected to their trial citing that Nabweru court had no jurisdiction to try them because the offences against them were allegedly committed in Mpondwe boarder Post in Kasese District and Nasser Road in Kampala and thus they cannot be tried in Nabweru.
The lawyer submitted that the Nabweru court is supposed to try charges from Kawempe and Nabweru Divisions and trying the accused in this court amounts to the abuse of court process by the Directorate of Public Prosecution.
In response prosecution led by Hope Mutoni who was ready to proceed with her two witnesses asked court for more time so as to reply to the issues raised by the defense.
The trial grade magistrate Mfitundinda, adjourned the matter to to Wednesday October 2nd to enable the state to respond to the defense.
The suspects, who are part of the missing four who were granted bail and re-arrested, have been sent back to Luzira prison, remanded until Wednesday 2nd October.
The Prosecution alleges that Shafiq Kasujja while at Nasser Road in March 2017, unlawfully designed and printed a National Identification Card in the names of Andrew Kwesiga which was later found with Higenyi Noordin Aramathan.
The Prosecution further contends that Bruhan Balyejusa also known as Masiga at the same time was found unlawfully possessing four National Identification Cards.
The said Identification Cards reportedly belonged to two of his co-accused and others were for a one John Bwambale and Richard Toddy.
